Roliup Terms of Use
Scope: These terms apply to the app Roliup by Agnaes Software on Android (Google Play, package io.agnaes.roliup.app) and on the iPhone (App Store), including the one-time unlock Roliup Deluxe. They supplement the terms of the store you get the app from; where both say something about obtaining the app and paying for it, the store's terms apply.

§ 2 The app
Roliup is a skill game: you steer a marble through handcrafted levels, in the 2D world by tilting your phone, in the 3D world with one finger. The app is free. 212 of the 374 levels can be played for free, with no time limit; the remaining level groups are opened by Roliup Deluxe (§ 3).
The app needs no account, no sign-in and no subscription. You can play without internet; a connection is needed only by the store for the purchase and, on Android, by the ads (§ 4). We run no service of our own behind the app: the app itself sends no data to us.
§ 3 Roliup Deluxe
Roliup Deluxe is a single one-time purchase, not a subscription. It unlocks every remaining level group in both worlds and, on Android, ends the ads for good. The price is shown in the store.
The purchase goes through the store's payment system (Google Play or the App Store) under its terms. We receive no payment details, only the store's confirmation that the purchase belongs to your store account. After a reinstall, or on another device with the same store account, Deluxe is available again: on Android the app asks the store at every start, on the iPhone the app's Settings offer “Restore Purchases”.
Refunds are handled by the store under its rules (Google Play or Apple). Your statutory rights as a consumer are unaffected. For questions about a purchase, write to web@agnaes.io.
§ 4 Ads
The free Android version shows ads between levels (Google AdMob). The app asks for your consent first; what is processed is described in the privacy policy of the Android app. With Roliup Deluxe the ads end for good. The iPhone app shows no ads.
§ 5 Licence
You may use the app privately on your own devices. The licence is non-exclusive and non-transferable. You may not modify, copy, redistribute or commercially offer the app, decompile it except where the law expressly allows it, or use the app's levels, music and graphics outside the app. Videos you record with the app's export function you may share freely.
§ 6 Progress and data
Progress, stars, best times and coins are stored by the app on your device. On the iPhone, Apple's iCloud keeps a copy in your own iCloud account so that you find them again on a new device; on Android, your Google account's device backup may include them. We have no access to this data. If you delete the app, locally stored data is lost.

§ 7 Updates and changes
We keep developing the app and deliver updates through the store. Levels, features and design may change. Content you have bought stays unlocked. There is no claim to particular future content or to support for old operating system versions; your statutory rights regarding updates are unaffected.
§ 8 Liability
We are liable without limit for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of an essential contractual duty, and then limited to the foreseeable damage typical for the contract. Liability under the Product Liability Act and under a guarantee is unaffected.
§ 9 Applicable law and dispute resolution
German law applies. If you are a consumer living in another state, you keep the mandatory protections of that state. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
